Alternative Dispute Resolution Can Work For You!

Various forms of alternative dispute resolution (ADR) can be utilized to reach amicable resolution of disputes - any kind of dispute - for far less money, time, and aggravation as compared to litigation. How does ADR work and what types of options are available for alternate ways to resolve disputes?

At ADR Works, based in Lexington, our alternative dispute resolution practice provides three distinct services:

MEDIATION

Mediation is a process by which both parties agree to present their dispute to a neutral mediator for potential resolution. The mediator works with the parties to develop a fair settlement that addresses both parties' positions - so both parties can be satisfied with the dispute's resolution.

Kentucky attorney Karen Walker is the chief mediator for ADR Works. Unlike some mediators, she has received specialized mediation training and is certified by the Mediation Center of Kentucky. ARBITRATION

Arbitration is a somewhat more adversarial process, and it is more like litigation than mediation. Many parties arrive at arbitration typically because a contract they signed requires that they resolve disputes through arbitration. Arbitration clauses are becoming more common in contracts and have been incorporated into contracts for financial and employment services for more than a decade.

Typically, arbitration is binding, which means the arbitrator's decision is final and the parties are contractually barred from pursuing litigation or "appealing" the arbitrator's decision. ADR Works maintains an extensive network of highly qualified arbitrators in a wide variety of specific fields. ADR Works provides single presiding arbitrators or arbitrator panels typically consisting of three arbitrators with one serving as the chief arbitrator.

FOCUS GROUPS AND MOCK TRIALS

Focus groups and mock trials are exceptionally helpful tools for attorneys on the verge of litigation or facing an impending trial date. A focus group - also called a mock trial or mock jury - allows the parties' lawyers to present their case to a panel of citizens, just like in a jury trial. In this process, however, the attorneys are allowed to observe deliberations in order to identify and evaluate each side's strengths and weaknesses.

This process facilitates settlement negotiations by giving the parties an idea of what might happen at trial. Focus groups and mock trials are far less time-consuming and less costly than actual litigation, and they provide essential information that can help the parties evaluate settlement offers.
